By using our Web site or by making purchase of services or merchandise ("Product") by any means made available, you are accepting the following terms of service so please read them carefully. The term "Wild West Electronics®" or "WildWestElectronics.com" or "WildWestElectronics.net" or "us" or "we" or "our" refers to Wild West Electronics®, Inc., the owner of the Web site. The term "you", "your" and "yours" refers to the user, viewer or customer of our Web Site.
1. Privacy Policy
At Wild West Electronics®, we are committed to your online privacy & security. Please read our Privacy Policy, which is a part of this Agreement and may change from time to time.
2. Security
We take every precaution to protect our users' information. When users submit sensitive information via the website, your information is protected both online and off-line. Our online shopping cart, hosted by Yahoo! is held on a secure 128-bit SSL encryption server.
3. Copyright
The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site, except as allowed within this agreement or otherwise expressed in writing, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials. Some of the content on the site is the copyrighted work of third parties.
4. Service Marks
"Wild West Electronics®", "WildWestElectronics.com", "WildWestElectronics.net", "Straight Shootin' Hi-fi Specialists" and others are our service marks or trademarks. Other product and company names mentioned on the Site may be trademarks of their respective owners.
5. Errors, Corrections and Changes
We may make changes to the pricing, features, functionality or content of the Site at any time without notice to you. We do not represent or warrant that the product information, pricing, or other information available on or through the Site will be correct, accurate, timely or otherwise reliable. We do not represent or warrant that the Site will be error-free, free of viruses or other harmful components, or that defects will be corrected. We reserve the right in our sole discretion to edit or delete any documents, information, prices or other content appearing on the Site.
If you place an order for Product(s) that were mispriced, you will be notified by your Sales Consultant in most cases. We apologize for the inconvenience. Please understand that we reserve the right to cancel any order for any reason at any time.
6. Payments
We accept the following forms of payment for your online purchases: MasterCard, Visa, Discover, American Express and PayPal. For your online purchases, you may purchase multiple Products in a single order, and we'll accept one credit card and up to one Gift Card for each order.
We do accept online-only or virtual credit cards as long as they are issued by one of the credit card companies listed above. However, due to the requirements of these companies, these cards can only be used for website orders that are shipped.
We do accept Checks and Money Orders. If paying by Check, please allow 7-10 business days for your Check to clear prior to us processing and shipping your order. Sorry, but at this time we are unable to accept purchase orders, cash, C.O.D. orders and wire transfers for any website purchases.
You represent and warrant that if you are purchasing something from us that (i) any credit information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes.
7. Sales Taxes
We withhold applicable sales tax for orders to be delivered to addresses within Oklahoma. Each customer shall be solely responsible for any and all applicable sales taxes, or other taxes, on orders shipped to any other location.
8. Order Fulfillment and Shipping
You may have your Products shipped or delivered to you via one of our available shipping options. We ship orders on normal business days, which are Monday through Friday excluding government holidays. Weekend shipment of orders is not currently available. Orders requesting any of our available shipping methods including any Express Air services (i.e. Next Day, Second Day, Three Day et cetera) will usually leave our warehouse within 1-2 business days (excluding weekends, holidays, date of order).

You assume all risk of loss for shipped Products. Order information such as billing or shipping address that is inaccurate or incomplete may result in delays. Products can not be shipped to incomplete addresses. Because 3rd party companies handle the shipping all orders, we cannot guarantee any exact shipping arrival date or time regardless of the shipping method used. All shipping times are best estimates only. All shipping charges are non-refundable.
Special & Foreign Addresses:
At this time, we can only ship PayPal confirmed paid orders containing cables, wires and other non-electronic accessories that are shipping to PayPal confirmed special addresses located outside of the lower 48 United States that include APO/AE, US Territories (i.e., American Somoa, Puerto Rico, Virgin Islands (U.S), Guam et cetera) and the following foreign international locations:

Hawaii and Alaskan Customers: If you are having your order shipped to Hawaii or Alaska, additional shipping charges over an above what our site calculates for shipping may apply. Due to the size and weight of some Products, they may not be available residents of Hawaii or Alaska. If you fall into this category, we will contact you prior to finalizing your order.
9. Shipping Damage
In the unlikely event you receive a product that has been damaged during shipping, you must contact us within 24 hours or by the next business day if received on a weekend, holiday or any other time our office may be closed, so we can help you file a claim with the carrier.
For freight deliveries, you assume all risk of loss once you sign for the delivery unless damage is clearly noted on the drivers copy of the signed freight bill and we are contacted within 24 hours or by the next business day if received on a weekend or holiday. We always encourage you to carefully inspect the freight prior to accepting the delivery and contacting us immediately if you have any questions.
You agree to cooperate with us and the respective shipping carrier to the best of your ability during the entirety of the shipping damage claims process.
All shipping charges are non-refundable.
10. Order Cancellations
We are unable to refund any online purchase from the time your order is placed (when you click the Submit Order button) until your Product is received by you and returned to us. If you're not 100% completely satisfied with your purchase after receiving your Product, please review our return and policy below to determine your preferred method of return.
11. Low Price Guarantee
Nothing's worse than paying too much. That's why we do everything in our power to make sure you don't pay a penny more than you should for anything you buy from Wild West Electronics®. If you've seen a lower advertised price from a local store with the same item in stock, we want to know about it. Prove it at the time of your purchase, and we'll gladly beat their price by 110% of the difference.
Additionally, we will price protect your purchase 7 days from your purchase date. If Wild West Electronic's price reduces, we will gladly credit you the 110% of the difference upon your notification.
Our policy applies only to advertised prices. It does not apply to special offers or promotions, including rebates, free-with-purchase offers, and special financing. In order to take advantage of our Low Price Guarantee, you must call or email us, as we do not provide electronic online price matches.
Due to the large number of unauthorized grey market resellers; we cannot match mail order, Internet retailer prices or any other dealers who are not authorized or cannot be verified to be authorized by the manufacturer.
Any difference will automatically be refunded to your original payment method.

12. Returns and Exchanges
If you're not 100% completely satisfied with a Product you purchased, Wild West Electronics® will gladly exchange or refund your Product within 30 days** of the sale date as detailed below:
- Non-Defective Returns:
- Non-defective Product returned to us for a refund will be credited to your original form of payment less our actual cost we incurred in connection to shipping your Product to you regardlesss of any amount you may have been charged including promotional "Free Shipping".
- Defective Returns:
- Defective Product returned to us for a refund will be credited to your original form of payment less our actual cost we incurred in connection to shipping your Product to you regardlesss of any amount you may have been charged including promotional "Free Shipping".
- Defective Exchanges:
- If the Product you received is confirmed by us to be defective, you may exchange the defective Product for an identical Product at no shipping cost to you for ground service. If you elect NOT to make an identical Product exchange, your order will be subject to our standard return policies.
**Televisions, Projectors, DLPs, LCDs, Digital cameras, camcorders, desktop PCs, notebook PCs, monitors, printers, scanners and radar detectors must be returned within 14 days of the sale date, and (except where prohibited by law) are subject to a 15% restocking fee if returned opened or in a non-factory sealed box.
**Custom made items, special order items, items purchased in connection with a trade-in or any other made-to-order type items are non-refundable for any reason. Examples include but are not limited to custom made-to-order cables, speaker wire sold by-the-foot, special order items.
**Headphones, Earbuds and In-Ear speakers do not qualify for our return policy unless they are unused or unopened. This is due to health issues.
For any exchange or refund, we need the original receipt or a record of the original purchase in our system. The product must be in its original condition and must include all original materials including but not limited to the the box, UPC bar code, packaging, and all accessories.
Opened software, music, games, and movies may be exchanged for the same title only.
Charges for installation and shipping and or delivery services are nonrefundable after the services have been performed.
Missing accessories: The value of missing items will be deducted from the credit amount of a return. For identical even exchanges, we will exchange what the customer returns (e.g., box for box, manual for manual, etc.)
Promotional Packages: Returns for promotional package Product will only be accepted if all components of the promotional package are returned. Individual package components may be exchanged if defective.
For Any Product Received that is not the Product Ordered: For Any Product Received that is not the Product Ordered, we will exchange the item at no additional cost upon verification. Proof of purchase (e.g. order confirmation, packing slip or record of purchase in our system) is required for all returns.
Prior Return Authorization Required for All Returns and Exchanges: Product purchased online through ww.wildwestelectronics.com or www.wildwestelectronics.net or via any of our provided contact information including but not limited to our toll-free number, direct number, fax number or email addresses, which meets the Refunds and Returns guidelines above, may be returned via mail to our authorized return center. Before returning anything by mail to us, you first must obtain a Return Authorization ("RA"). RA's can be obtained by emailing us your Return Authorization Request or by contacting customer service by telephone at (405) 340-8951 during normal business hours.
- Any returns mailed to us without a pre-approved RA may be refused without notice, automatically returned and a handling fee assessed. An RA is valid for 10 days.
- You will be responsible for all shipping and insurance charges for returned Product, unless otherwise indicated.
- If you choose to NOT insure your package, and we do not accept return of the Product, you will be responsible for any loss or damage.
Refunds
Upon our acceptance of your returned merchandise in conformity with our return policies outlined above; the purchase price less any charges in conformity with our return policies will be credited to the original form of payment used by you. Please allow 14 days (not including delivery time for mail refunds) from when we receive your returned item(s) for the processing of your credit.
13. Reward Points Program
Earning Product Reward Points
- Reward Points are earned on both online purchases and purchases made by telephone only.
- Each $ dollar you spend earns you 1 Reward Point. Each Reward Point you earn is good for .05 cents towards a future purchase.
- Reward Points amounts may vary per product. Not all products may be eligible to earn Reward Points.
- Generally your most current Reward Points balance can be found at the bottom of your physical packing slip invoice for items Wild West Electronics® ships directly. For all other items that may be direct shipped from our vendors, you can
Send Us a Request for
an invoice copy to obtain your most current Reward Points balance. Wild West Electronics® is also working on a way to check Reward Points balances online in the future.
- Reward Points can only be earned for purchases made on or after May 15th 2008. All purchases made prior to May 15th 2008 are not eligible and do not qualify for the Reward Points program.
Redeeming Reward Points Earned
- Reward Points can be redeemed online or over the phone at Wild West Electronics® dot com or Wild West Electronics® dot net. If redemption is to be made online, simply type in "Redeem My Rewards Points" in the comments section of your order. Your credit card will only be charged for the amount beyond the value of your Reward Points Earned.
- Reward Points expire 6 months from the date your order was placed.
- Reward Points are forfeited on all returned merchandise or cancelled orders.
- Reward Points are not redeemable for cash, can not be returned for a cash refund, and can not be applied to any existing credit card balance.
- Reward Points carry no cash value and are not gift certificates.
- Reward Points cannot be redeemed in combination with any other promotional offer, coupon or any other special discount. This exclusion does not apply to "Free Shipping" offers.
- When redeeming Reward Points, your order subtotal (total before tax, shipping and handling) must exceed the amount of your Reward Points. Taxes, fees, shipping, handling and any applicable restocking charges are extra and vary. Special promotions that are based upon your order total (i.e. free shipping) will be based upon your subtotal after your reward points have been applied. All remaining balances must be paid with a credit card.
- On orders where Reward Points are being redeemed, the amount of the redeemed Reward Points will be subtracted from the amount of earned Reward Points.
- We are not responsible for lost or stolen Reward Points.
- Reward Points are not transferable and must be redeemed using the billing and shipping address on file.

- Wild West Electronics®, Inc. reserves the right to cancel the Reward Points program at any time without notice.
- WILD WEST ELECTRONICS®, INC. AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO REWARD POINTS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
14. Rebates Offered by Manufacturers
Rebate and coupon offers provided by manufacturers are subject to the terms specified by the manufacturer. These terms may include the timeframe of the offer, limitations on quantities and combination with other offers. Proof of purchase, UPCs from the original packaging and postage are normally required for redemption of rebates by the manufacturer or the manufacturer's agent.You assume all risk of loss for the use of manufacturer rebates.
15. Linking to the Site
You may provide links to the Site, provided (a) that you do not remove or obscure, by framing or otherwise, advertisements, the copyright notice, or other notices on the Site, (b) your site does not engage in illegal or pornographic activities, and (c) you discontinue providing links to the Site immediately upon request by us.
16. Registration
Certain sections of, or offerings from, the Site may require you to register. If registration is requested, you agree to provide us with accurate, complete registration information. Your registration must be done using your real name and accurate information. Each registration is for your personal use only and not on behalf of any other person or entity. We do not permit (a) any other person using the registered sections under your name; or (b) access through a single name being made available to multiple users on a network. You are responsible for preventing such unauthorized use.

Third party content may appear on the Site or may be accessible via links from the Site. We are not responsible for and assume no liability for any mistakes, misstatements of law, defamation, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations or any other form of content on the Site. We reserve the right, and you authorize us, to the use and assignment of all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. All remarks, suggestions, ideas, graphics, or other information communicated by you to us (collectively, a "Submission") will forever be our property. We are not responsible for the content, accuracy or opinions express in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. 20. Copyrights and Copyright Agents
We respect the intellectual property of others, and we ask you to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent the following information:

We reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information.
26. Indemnification
You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, attorneys, advertisers, product and service providers, and affiliates (collectively, "Affiliated Parties") harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.
27. Nontransferable
Your right to use the Site is not transferable or assignable. Any password or right given to you to obtain information or documents is not transferable or assignable.
28. Disclaimer
THE INFORMATION, CONTENT AND DOCUMENTS FROM OR THROUGH THE SITE ARE PROVIDED "AS-IS," "AS AVAILABLE," WITH "ALL FAULTS," AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THIS SITE AND THE PRODUCTS, SERVICES, DOCUMENTS AND INFORMATION PRESENTED WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US THROUGH THE SITE OR OTHERWISE SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.
ALL RESPONSIBILITY OR LIABILITY FOR ANY DAMAGES CAUSED BY VIRUSES CONTAINED WITHIN THE ELECTRONIC FILE CONTAINING A FORM OR DOCUMENT IS DISCLAIMED.

29. Limitation of Liability
(a) We and any Affiliated Party shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from (a) any errors in or omissions from the Site or any services or products obtainable therefrom, (b) the unavailability or interruption of the Site or any features thereof, (c) your use of the Site, (d) the content contained on the Site, or (e) any delay or failure in performance beyond the control of a Covered Party. (b) THE AGGREGATE LIABILITY OF US AND THE AFFILIATED PARTIES IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE AND/OR THE PRODUCTS, INFORMATION, DOCUMENTS AND SERVICES PROVIDED HEREIN OR HEREBY SHALL NOT EXCEED $100 AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES WHICH YOU MAY HAVE AGAINST US AND ANY AFFILIATED PARTY.
30. Legal Compliance
You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Site and the Content and Materials provided therein.
31. Miscellaneous & Governing Law
This Agreement shall be treated as though it were executed and performed in Edmond, Oklahoma and shall be governed by and construed in accordance with the laws of the State of Oklahoma (without regard to conflict of law principles). Any cause of action by you with respect to the Site (and/or any information, Documents, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in Section 16 and Section 17. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. This Agreement and all incorporated agreements and your information may be automatically assigned by us in our sole discretion to a third party in the event of an acquisition, sale or merger. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under this Agreement shall survive any termination of this Agreement.
32. Acceptance of Agreement
You agree to the terms and conditions outlined in this Terms of Service Agreement ("Agreement") with respect to our site (the "Site"). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.
